Personal data protection

The Attorney-at-Law, as a data controller, undertakes to process the personal data provided by the Client hereunder in accordance with applicable laws and regulations, including but not limited to Act No. 85/1996 Coll. (Act on the Legal Profession) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Legal basis for processing

  • Contract on provision of legal services
  • Provision of personal data is an obligation of the data subject – client, arising from the said contract.

Provision of legal services under the contract concluded with the client

  • Public authorities (e.g. courts, administrative authorities)
  • Other recipients based on client’s needs and instructions

Period of personal data processing

Personal data will be processed throughout the term of the above contract and at the end of its term, the personal data will be handled in accordance with applicable legislation, including but not limited to Act No. 85/1996 Coll. (Act on Legal Profession), Act No. 499/2004 Coll. (Act on Archives and Record Service and on Amendments to Certain Acts) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Client’s rights

Right of access to personal data means the client has the right to obtain information from the data controller – Attorney-at-Law – about whether their personal data are processed and if so, which personal data are processed and how. The client also has the right for any inaccurate personal data related to the client to be rectified by the Data Controller – Attorney-at-Law without undue delay on request of the client. The client has the right to complete any incomplete personal data anytime.

Right to erasure of personal data provides for the obligation of the Data Controller – Attorney-at-Law to dispose of any personal data processed in relation to the client, as long as the statutory conditions are met, on request of the client.

The client has the right for the Data Controller – Attorney-at-Law to restrict the processing of the client's personal data in certain cases. The client has the right to object to processing based on legitimate interests of the Data Controller – Attorney-at-Law, a third party, or processing necessary for performance of a task carried out in the public interest or subject to the exercise of public authority anytime.

Right to data transferability gives the client the opportunity to obtain the personal data provided to the Data Controller in a standard, machine-readable format. These data may subsequently be transferred to another data controller or, if technically feasible, request the data controllers exchange the data.

The right to withdraw the consent to personal data processing anytime shall not apply, since the client's personal data are processed for the purpose of performance of a contract concluded with the client, not under a consent to data processing.

If the client is dissatisfied with their personal data processing performed by the Data Controller – Attorney-at-Law in any way, the client is entitled to file a complaint with the Data Controller directly or with the Office for Personal Data Protection.
